The Police
The job of the police is to build a case against you when they think you have broken the law. It’s not their job to help you. Do not be naïve and think that you can work with the police without a lawyer. Too often when foreigners are in trouble in Thailand they prefer to trust their wife, girlfriend, their friends, their wife’s friend of a friend of a friend who knows someone who can help. Direct negotiations with the police without a lawyer subject you to information extraction techniques and methods that are unknown to you. It is the job of the police to extract information to use against you, it is very easy to unknowingly provide information that will cement their case against you.

Our firm handles communications with the police in criminal matters on behalf of our clients. You should never attempt to communicate with the police either on your own or with a friend or relative. This will expose you and/or your friend/relative to further arrest and/or clever trickery designed to build a stronger case against you.  Serious and irreversible problems can occur should you attempt to deal with the police on your own. As in your home country, you should never talk with the police without legal counsel. Never answer police questions. In Thailand, you have the right to remain silent.

The Prosecutor
It is the prosecutor’s job to use the case/evidence supplied by the police to convict you in a court of law. The prosecutor has great authority and can ask the police to investigate further.  The prosecutor and the police will prepare and protect the witnesses against you. The written law states the prosecutor must prove the case against you beyond a reasonable doubt. In reality, your legal team must demonstrate your innocence by discrediting all evidences and witnesses brought by the police and prosecutor.

The Court 
The police and prosecutor have great power and resources to build and present a convincing case against you. All cases in Thailand start with an accusation. Police and prosecution build their cases to support the accusation. Your case will be decided by a judge, not a jury. In theory, up to three judges can be involved with deciding your case. In practice, one judge will decide your case. The judge is the only person involved in your case who is alleged to be fair and impartial. It is unwise to assume this is the case.  While the written law may state the police and prosecution must prove that you committed the crime beyond a reasonable doubt, the reality is that you will need to prove your innocence. Your lawyers must destroy the primary evidences and testimonies of the case presented by the police and prosecution. This requires an enormous amount of preparation. Regarding defense witnesses and evidences: Thai judges give very little, if any, weight or consideration to defendant’s witnesses and evidences.

Preparation, research and investigation, and a talented trial lawyer are part of a winning strategy in a criminal trial. Preparation is critical. It’s like studying for a test. If you don’t study you will surely fail. If you put the time in and study hard you will pass. Without tedious preparation the chances of success are quite low. You must understand that your defense attorney can only do his best work for you when you have the resources to provide compensation for the time necessary to effectively prepare.
